The Legal notice of www.madridsubterra.es is designed to comply with the information obligation stated in Article 10 of the Law 34/2002 of July 11 on Information Society Services and Electronic Commerce. This Article obliges all service providers and sets out the Portal use rules that all users will have to apply as a consequence of its use. We also inform you that this site does not accept publicity.
1 Who we are
In accordance with Article 10 of the Law 34/2002 of July 11 on Information Society Services and Electronic Commerce (hereinafter referred to as «LSSI»), we inform you that the website with the URL: www.madridsubterra.es (hereinafter referred to as «Website» or «Portal») is operated by the Association Madrid E+Subterra (hereinafter referred to as «Madrid Subterra»), with reference number G87153227, recorded at the Register of Associations of the Community of Madrid, Section one, with number 35.130, established in 41 Bailén Street, 28005 Madrid. 2 Content of the Legal Notice
2.1 Acceptance of the Legal Notice
The present Legal Notice regulates the use of the information society services that Madrid Subterra supplies to Internet users through the Website.
We also inform the User that a previous registration in the Website is not necessary in order to participate in the services and functionalities offered by Madrid Subterra through the Portal.
2.2 Use conditions of the Portal
Accessing the Website is free, except for the cost of connection through the telecommunications network provided by the service provider contracted by the user.
The User commits not to use the Website for fraudulent purposes, and not to carry out any form of conduct that could damage the image, interests or rights of Madrid Subterra or third parties. The user also undertakes not to damage, disable, overload and deteriorate the Website or prevent its normal use.
We finally inform the User that Madrid Subterra reserves the authority to decide on the continuity of the information society services offered through the Portal at any time.
2.3 Industrial and Intellectual Property
The intellectual property rights in the Portal content disposal (sui generis rights in databases), its graphic design (look & feel), underlying computer programs (included in the source codes), as well as the elements that constitute the Portal (texts, graphics, pictures, videos, sound recordings, etc.) hereinafter referred to as the «Contents», belong to Madrid Subterra or its Licensors.
The use of the Portal by the User does not imply the assignment of any intellectual and/or industrial right over the Website, the Contents and/or the distinctive signs of Madrid Subterra. To this end, the reproduction, transfer, distribution, public communication, making available, extraction and/or reusing of the Portal, its Contents and/or the distinguishing signs of Madrid Subterra are expressly prohibited to the User by means of the present Legal Notice, unless it is legally allowed or it has the previous authorisation of Madrid Subterra.
2.4 Linking Policy (Links)
2.4.1 Establishment of links to the Portal
It is prohibited to establish any links to the Website, unless it has been previously authorised by Madrid Subterra. In case of authorisation, the links will have to be established under the following terms:
- The link may only connect to the home page or the main page of the Portal.
- The link may not involve frames that enable the visualisation of the Portal through web addresses other than the Website, or web addresses that commonly display the information of the Portal included in other websites.
- The page bearing the link (hereinafter referred to as «Linking site») may not incur in any type of false, inaccurate or incorrect statement about the Portal and/or Madrid Subterra.
- The Linking site may not indicate in any case that Madrid Subterra has given its consent to insert the link it sponsors or that it verifies, supervises, collaborates with and that it approves its content and/or the services offered in the Linking Site.
- The Linking Site must comply faithfully with the Law and shall not provide or link to contents themselves or third parties that: (i) are illegal, harmful or contrary to morals and good customs (pornography, violence, racism, etc.); (ii) includes or may include misleading information about Madrid Subterra endorsing or supporting in any way the ideas, declarations or licit and illicit substances from the sender; and (iii) inappropriate or not relevant data about the activity of Madrid Subterra.
In the event of breach of any of the terms mentioned before, Madrid Subterra will immediately and without prior notification proceed to remove the link.
2.4.2 Linked Sites
With the aim of helping you find additional information, we have included several technical devices of linkage that allow the User to access other websites (hereinafter referred to as “Links”). In these events, Madrid Subterra acts as a provider of brokerage services in accordance to the Article 17 of Services for the Information Society. In accordance with this legislation, Madrid Subterra will not be responsible for the services and contents provided in the Linked Sites, unless it is effectively aware of wrongfulness and has not turned off the link with due diligence.
If the User considers that there is a Linked Site with illegal, harmful, denigrating, violent or inappropriate content, he or she may inform Madrid Subterra through the following email address: firstname.lastname@example.org. This information will however not imply the obligation from Madrid Subterra to remove the corresponding link or implies the effective awareness from Madrid Subterra of the wrongfulness of the Linked Sites contents, for the purposes of the existing rule.
2.5 Responsibility of Madrid Subterra
The User admits and accepts that the contents and informations included in the Website are for information purposes only, despite the fact that Madrid Subterra makes its best efforts to ensure their accuracy. Therefore, Madrid Subterra does not take responsibility for the decisions the User makes based on the information provided by the Web Site, or for any damages and harm that the User or third parties may suffer due to decisions based on the information obtained from the Web Site.
Furthermore, the access to the Website does not imply obligation by Madrid Subterra to control the absence of virus, computer worms or any other harmful computer elements. In any case, the use of the appropriate tools for the detection of these harmful elements depends on the User. As a consequence, Madrid Subterra will not take any responsibility for damages in the computer equipment of the Users or third parties caused by the services offered in the Website.
Service availability requires services and supplies from third parties, including transport services through telecommunications networks whose reliability, quality and operation does not depend on Madrid Subterra. Therefore, Madrid Subterra does not guarantee the availability of the Website and informs that the services it offers may be interrupted, suspended or cancelled at any time. In particular, Madrid Subterra neither takes responsibility for any form of damages caused by the User as a consequence of the lack of availability in the Website, nor for damages caused by failures related to telecommunications networks. Also, Madrid Subterra reserves the right to revise the Website or refuse access to it at any time.
2.6 Data protection
Tal y como se indica en el apartado 2.1 del presente Aviso Legal, los aspectos relativos al tratamiento de los datos personales de los Usuarios con motivo del uso del Portal se hallan regulados en la Política de Privacidad, así como en los textos legales adjuntos a los diversos formularios de recogida de datos incluidos en el Portal.
In accordance with the Article 3 of the LSSI, the applicable laws to the information society services that Madrid Subterra provides through the Portal will be those corresponding to the Kingdom of Spain.
If any of the provisions contained in the present Legal Advice are declared null, we will proceed to its removal and replacement. The declaration of null will not affect the validity of the remaining provisions included in this Legal Advice in any case.
